The rules for using this website. Client work is governed by a separate agreement.

Plain summary. This page covers the use of this website. It is not the contract for any work we do for you — that is a separate written agreement, and where the two disagree, that agreement wins.

1. Agreement

These terms govern your use of realmarketing.ca (the “Site”), operated by Real Marketing of 55 Commerce Valley Dr W, Markham, ON L3T 7V9. By using the Site you accept them. If you do not, please stop using the Site.

2. What this page is not

Nothing on the Site is an offer capable of acceptance, a quote, or a contract for services. Project scope, fees, timelines, deliverables, revisions, ownership of work product, and payment terms are set out in a separate written proposal or services agreement signed by both parties. Where these terms conflict with that agreement, that agreement governs.

3. Using the Site

You may view, browse, and print pages for your own use in evaluating our services. You may not:

  • copy, republish, or resell Site content as your own;
  • scrape, harvest, or bulk-download the Site or its images;
  • submit the contact form for spam, solicitation, or automated testing;
  • attempt to breach, probe, or disrupt the Site or its hosting;
  • use the Site for anything unlawful, or in a way that infringes anyone's rights.

4. Intellectual property

The Site's design, code, copy, photography, and the Real Marketing name and logo are owned by us or licensed to us, and are protected by Canadian and international copyright and trade-mark law.

Portfolio and case-study material is shown to demonstrate work we have produced. Client names, logos, and trade-marks appearing on the Site remain the property of those clients and are used to identify the work, not to imply any endorsement of you or of anyone else. Ownership of work we produce for a client is determined by that client's agreement with us, not by its appearance here.

5. What you send us

You are responsible for the accuracy of anything you submit and for having the right to send it. Do not send confidential material through the contact form — it is a public web form and we cannot treat an unsolicited submission as confidential. If we need to receive something in confidence we will arrange it separately.

By submitting an enquiry you give us permission to use its contents solely to evaluate and respond to your request.

6. Availability

We aim to keep the Site available and current, but we do not guarantee it. We may change, suspend, or withdraw any part of it, at any time, without notice.

7. No warranty

The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Statistics, results, and case studies describe outcomes achieved for specific clients in specific circumstances and are not a prediction or guarantee of results for you.

8. Limitation of liability

To the fullest extent permitted by law, Real Marketing is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of your use of the Site. Our total aggregate liability arising from the Site is limited to CAD $100.

Nothing here excludes liability that cannot lawfully be excluded, including liability for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

9. Third-party links

The Site links to client websites, social platforms, and other third-party resources. We do not control them, we do not endorse their content, and we are not responsible for them.

10. Privacy

Our handling of personal information is described in our Privacy Policy and Cookie and storage notice, which form part of these terms.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute, and you consent to that jurisdiction.

12. Changes

We may update these terms. The revision date at the top of this page shows when we last did. Continuing to use the Site after a change means you accept the updated terms.

13. Severability

If any provision here is found unenforceable, it is severed and the rest stays in force.
